By booking, purchasing or participating in any service at Fatigue Lounge, you acknowledge that you have read, understood and agreed to these Terms of Service & Conditions.
These terms apply to all bookings, services, memberships, packages and gift vouchers unless otherwise stated.
Appointments are subject to availability and must be booked in advance.
Your booking is confirmed once the required booking and payment details have been completed.
Please arrive at least 5–10 minutes before your scheduled appointment where possible, particularly if you are visiting Fatigue Lounge for the first time.
Please arrive on time for your appointment.
If you arrive late, Fatigue Lounge may need to shorten your session to avoid affecting the next customer’s booking.
Your session will not ordinarily be extended because of a late arrival, and the full booked service price will still apply.
If a late arrival means the service cannot reasonably be provided, Fatigue Lounge may treat the booking as a cancellation or no-show.
You may cancel or reschedule your appointment without a cancellation fee provided you give at least 24 hours’ notice before your scheduled appointment time.
Cancellations or rescheduling requests made less than 24 hours before the scheduled appointment, or failure to attend your appointment, may incur a cancellation fee of 50% of the booked service price.
The cancellation fee may be charged to the payment method held on file where applicable.
Fatigue Lounge may waive the cancellation fee at its discretion in exceptional circumstances.
Nothing in this cancellation policy limits any rights or remedies you may have under the Australian Consumer Law.
A no-show occurs when a customer fails to attend their scheduled appointment without providing notice.
No-shows may incur a 50% cancellation fee.
Repeated no-shows or late cancellations may result in Fatigue Lounge requiring pre-payment for future bookings or restricting future bookings, subject to applicable law.
Gift vouchers may only be used in accordance with the conditions stated on the voucher.
Gift vouchers are not redeemable for cash and cannot ordinarily be exchanged for cash or other consideration.
Gift vouchers are non-refundable for change of mind, except where a refund or other remedy is required under Australian Consumer Law.
Gift vouchers may not be transferred or resold unless Fatigue Lounge agrees otherwise.
Packages are purchased for the services and number of sessions specified at the time of purchase.
Packages are intended for use by the original purchaser and are not transferable unless Fatigue Lounge agrees otherwise.
Packages are non-refundable for change of mind, except where a refund, cancellation or other remedy is required under Australian Consumer Law.
Package expiry dates will be communicated at the time of purchase.
Unused sessions after the applicable expiry date may be forfeited unless otherwise agreed by Fatigue Lounge or required by law.
Memberships are personal to the named membership holder and are not transferable.
Membership benefits may only be used by the primary membership holder.
Memberships cannot ordinarily be paused or placed on hold and will continue to run from the activation/start date until the stated expiry date.
Membership benefits must be used within the membership period and cannot ordinarily be exchanged for cash.
Memberships are non-refundable for change of mind, except where a refund, cancellation or other remedy is required under Australian Consumer Law.
Membership terms, inclusions, expiry dates and applicable booking conditions will be communicated at the time of purchase.
SERVICE AVAILABILITY & EQUIPMENT
Fatigue Lounge may need to temporarily modify, restrict or suspend a service due to:
Where Fatigue Lounge is unable to provide a booked service, we will endeavour to provide reasonable notice where possible and, where appropriate, offer to reschedule the booking or provide another appropriate remedy.
Nothing in these terms limits your rights under Australian Consumer Law.
WELLNESS SERVICES & MEDICAL DISCLAIMER
All services and equipment provided by Fatigue Lounge are intended for general wellness, relaxation and recovery purposes only.
Fatigue Lounge and its staff do not provide medical advice, diagnosis or treatment.
Information provided by Fatigue Lounge staff is general in nature and should not be relied upon as a substitute for advice from a qualified healthcare professional.
Our services are not intended to diagnose, treat, cure or prevent medical conditions.
If you have any concerns about whether a service is suitable for you, you should speak with your GP or another appropriately qualified healthcare professional before booking or participating.
HEALTH CONDITIONS & MEDICAL CLEARANCE
You must inform Fatigue Lounge of any condition, injury, illness, disability, medication, pregnancy or other circumstance that may affect your ability to safely participate in a service.
If you have a pre-existing medical condition, injury, illness, disability or physical limitation, you should obtain appropriate medical advice before participating.
Fatigue Lounge may decline or modify a service where staff reasonably believe that participation may present a safety risk.
PREGNANCY
If you are pregnant, planning to become pregnant, or believe you may be pregnant, you should obtain clearance from your GP or another qualified healthcare professional before using any Fatigue Lounge service or equipment.
Certain services or equipment may not be suitable during pregnancy.
Customers are responsible for obtaining appropriate professional advice regarding their individual circumstances.
MINORS
Customers under 18 years of age may only participate where permitted by Fatigue Lounge and with the required consent of a parent or legal guardian.
Written parental or guardian consent may be required.
Minors must be supervised in accordance with Fatigue Lounge requirements and applicable law.
Fatigue Lounge reserves the right to refuse participation where appropriate supervision or consent has not been provided.
CUSTOMER RESPONSIBILITY
By booking and participating in a Fatigue Lounge service, you confirm that:
You must not use any equipment in a manner contrary to staff instructions or safety requirements.
Participation in wellness, recovery and recreational services may involve inherent risks, including risks associated with changes in temperature, heat, cold, water, physical positioning, pressure, light exposure, relaxation and other characteristics of the relevant service.
You should follow all instructions provided by Fatigue Lounge staff and immediately notify staff if you experience discomfort, dizziness, pain, shortness of breath, nausea, faintness or any other concerning symptoms.
To the extent permitted by law, Fatigue Lounge does not accept responsibility for loss or damage arising from a customer’s failure to:
Nothing in these Terms & Conditions excludes, restricts or modifies any rights, guarantees, warranties, remedies or liabilities that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
Where applicable law permits Fatigue Lounge to limit its liability, Fatigue Lounge’s liability will be limited to the maximum extent permitted by law.
IMPORTANT: Any statutory wording required for a recreational liability limitation should be inserted here following legal review.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy available under the Australian Consumer Law.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with a service, you may be entitled to:
You may also be entitled to compensation for other reasonably foreseeable loss or damage.
Fatigue Lounge does not provide refunds for change of mind where no refund is otherwise required by law.
However, nothing in this policy excludes or limits a customer’s rights under the Australian Consumer Law.
Where a service does not meet a consumer guarantee, Fatigue Lounge will provide the remedy required by law.
If you have a concern about a service, booking or experience, please contact Fatigue Lounge as soon as reasonably possible.
We will endeavour to understand the issue and work with you to reach an appropriate resolution.
Where applicable, your rights under Australian Consumer Law remain unaffected.
Fatigue Lounge may update these Terms & Conditions from time to time.
The terms applicable to a booking or purchase will generally be those provided to you at the time of booking or purchase, unless a change is required by law.
Where a material change affects an existing membership or ongoing arrangement, Fatigue Lounge will provide reasonable notice where appropriate.
By booking, purchasing or participating in a Fatigue Lounge service, you acknowledge that you have had an opportunity to read these Terms & Conditions and agree to comply with them.
If you do not agree with these terms, please do not book or participate in the relevant service.
